INTERVENTION BY INVITIATION AND IT’S REVEALED DISCUSSION AREAS IN TERMS OF INTERNATIONAL LAW

In the 77 year-period from the adoption of the UN Charter on June 24, 1945 to the present day, in state practices very important developments have been experienced in the field of the law of the use of force (jus ad bellum). The collective security system which is regulated in the chapter seven is rarely worked, the prohibition on the use of force which is regulated in the article 2(4() was violated very often and the right of self-defence which is regulated in article 51 has been interpreted quite broadly. These developments have also led to significant debates in the doctrine. Today these discussions the doctrine of “military intervention by invitation or consent” has been added. In practice, states more frequent rely on the doctrine of military intervention by invitation. These practices, on the one hand reshape the doctrine itself, on the other hand, they have different effects on the principle of negative equality, the principle of de facto effectiveness, the right of internal self-determination, the prohibition of interference in internal affairs and the principle of non-intervention.
