Critical Analysis and Discussion of the Legal and Practical Challenges Posed by Detention by Armed Groups During Armed Conflicts
International Humanitarian Law sets a legal framework to regulate armed conflicts despite such efforts legal issues arising from noninternational armed conflicts remain one of the greatest concerns throughout human history due to their complex nature, insufficient and lack of specificity of the provisions. Apart from the nature of these kinds of conflicts one might question the existing imbalance of regulation between the conflicts with an international and those of noninternational character. Is it inability to control such situations? Or is it a matter of unwillingness? Such a lack can be evidenced by the fact that all the four Geneva conventions are regulation to the international armed conflicts and only common article 3 and Additional protocol II are dedicated to those with a non-international character thus the insufficiency. This paper will focus on the detention by armed groups in armed conflict, the legal and practical challenges posed by such detention and the position of the international community on such matters. .
