THE TERM PENALTY UND THE SENSE OF CRIMINAL PUNISHMENT
It is heard in daily life and read the term of “penalty” almost everywhere. So, the term penalty is used in language. However, the term needs to be concretized: What does punishment actually mean? What is understood by the term punishment? Accordingly, it is useful to explain the concept and its meaning regarding the sociology of law, criminology and criminal law science through the conceptual design in this work. That leads us to the meaning of punishment, that is the punishment theories. The penal theories are also called "the theories regarding the purpose of penalty". The main lines of this theories are "retribution" and "prevention". Trough history, retribution has been the only cause of punishment. Against this background, the present work takes into account how the meaning and purpose of punishment has evolved in the historical process.
